icePhone OS – Custom License Agreement

1. Grant of License

The Licensor grants you a non-exclusive, non-transferable, worldwide license to use the Software for:

• Commercial projects, and
• Non-commercial projects,

subject to the restrictions outlined below.

2. Permitted Use

You may:

• Use the Software exclusively in Ren'Py-based games or applications.
• Include the Software as part of a finished Ren'Py project, whether commercial or non-commercial.
• Modify the Software solely for the purpose of integration into a Ren'Py project.
• Both original and modified versions of the Software may only be used within Ren'Py-based games or applications.

3. Restrictions

You may not, under any circumstances:

• Use the Software (or modified versions) outside of Ren'Py-based games or applications.
• Use the Software to create, sell, or distribute any standalone product, framework, operating system, asset pack, or toolkit.
• Redistribute, resell, sublicense, share, or make available the Software (or modified versions) by itself or outside of a Ren'Py project.
• Use the Software (or modified versions) to create derivative products intended for redistribution outside of Ren'Py projects.
• Claim ownership of the Software or represent it as your own work.

4. Redistribution Terms

Redistribution of the Software is strictly limited to the following condition:

• The Software may only be redistributed when embedded within a compiled or distributed Ren'Py game.
• Any redistribution outside of a Ren'Py project is expressly prohibited.

5. Ownership

The Software is licensed, not sold.
All rights, title, and interest in and to the Software remain the exclusive property of the Licensor.

6. No Warranty

The Software is provided "AS IS", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

In no event shall the Licensor be liable for any damages arising out of or related to the use or inability to use the Software, including but not limited to loss of profits, data, or business interruption.

8. Source Code Protection

You may not:

• Decompile, disassemble, reverse-engineer, or extract the source code from the Software or from compiled games containing the Software, except where such activity is expressly permitted by applicable law.
• Use automated tools or methods to extract, analyze, or separate the Software from any compiled distribution.
• Distribute, share, or make publicly available any extracted or decompiled portions of the Software.

These restrictions apply even if the Software is embedded within a compiled Ren'Py game.

9. Circumvention Clause

You may not circumvent, disable, or interfere with any technical measures used to protect the Software, including but not limited to encryption, obfuscation, or code protection mechanisms.

10. Game Embedding Definition

The Software is considered "embedded in a game" when:

• It is included as part of a complete, functional Ren'Py game project.
• It is compiled or distributed as part of a playable game executable or source distribution.
• It is used to provide functionality or features within the game context.

As long as the Software remains embedded within a functioning Ren'Py game and is not extracted, sold separately, or redistributed outside of the game context, no violation occurs.

11. Termination

This Agreement is automatically terminated if you violate any of its terms.
Upon termination, you must immediately cease use of the Software and delete all copies in your possession.
Termination does not limit other remedies available to the Licensor.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the European Union, and where applicable, the laws of the Member State in which the Licensor resides.
